联合国《关于保护面对死刑的人的权利的保障措施》第三条规定:
3. 犯罪时未满18岁的人不得判处死刑,对孕妇或新生婴儿的母亲,或精神病患者不得执行死刑。
Persons below 18 years of age at the time of the commission of the crime shall not be sentenced to death, nor shall the death sentence be carried out on pregnant women, or on new mothers, or on persons who have become insane.
“不得执行死刑”和“不得判处死刑”有什么区别?为什么要分别列举?
我觉得直接写成:犯罪时未满十八周岁者、孕妇、新生儿的母亲、精神病患者不得判处死刑。
这就可以了嘛。
判处死刑后不执行,和没有判死刑不是一模一样吗?
@陈士杰 #187221 不一样,将来如果对死刑的禁令被废除,那就可以执行死刑,或者是美国的death row,判了死刑还要排队,排到了才处决。如果没有判死刑,那将来也不能处决。
