    22修正案就是总统任期限两届案,这个显然是应对小罗斯福总统连任四届,对传统潜规则不连任超过两届的破坏。在小罗斯福死后,大家觉得总统连任威力太大,很容易通向专制,所以立法限制总统连任。

    小罗斯福死后美国国会选举,共和党夺取参众两院多数,他们开始鼓吹对总统连任的限制,并很快得到社会各界响应。毕竟小罗斯福为了超越潜规则连任,采取了各种不光明的手段排挤民主党内部反对派,甚至1944年大选为了当选而掩盖自身身体状况,结果在1945年连任后短短82天即死亡。大家一看就知道这就是独夫民贼的问题,如果罗斯福不是无限连任,他就不会掩盖身体状况而参选了。

    在杜鲁门上台后,限制连任的宪法修正案草案就开始流转,从1947年一直到1951年通过。

    第一条:

    No person shall be elected to the office of the President more than twice, and no person who has held the office of President, or acted as President, for more than two years of a term to which some other person was elected President shall be elected to the office of the President more than once. But this Article shall not apply to any person holding the office of President when this Article was proposed by the Congress, and shall not prevent any person who may be holding the office of President, or acting as President, during the term within which this Article becomes operative from holding the office of President or acting as President during the remainder of such term.

    任何人不得当选超过两届,如果代理总统或者继承总统超过两年的,只能当选最多一届。后面都是祖父条款,保证此条不能对当时的总统(杜鲁门)使用。

    第二条:

    This article shall be inoperative unless it shall have been ratified as an amendment to the Constitution by the legislatures of three-fourths of the several States within seven years from the date of its submission to the States by the Congress.

    日落条款。


    所以按照这里的规则,一个人最多能当十年总统。第一个任期是副总统,剩两年的时候原来的总统死亡或者辞职,然后当选两届就可以达到十年这个上限。那么有没有可能超过这个上限呢。

    有人想到让达到上限的去当副总统,再想办法夺权。但是注意12修正案的最后一句话,不能选举当总统的,也不能当副总统。也就是说不管是上选票去选副总统,还是让总统来任命达到上限的去当副总统,都是不可行的。

    那么有人问,给他其他职位然后继承呢?其实也不行,1948总统继承法里规定了,在继承顺位中,有人不符合当选总统条件的,在继承顺序中自动跳过。类似英国王室继承顺位,英国是规定了必须国教徒才能当国王,所以英国王室成员中改宗天主教的之类的人员被自动跳过。所以在22修正案和1948继承法的联合作用下,一个人当美国总统的上限就是十年,共两个半任期。

    关于总统继承和副总统任命的问题,还可以参考第25修正案。

    20: 总统任期从1月开始

    第20修正案又名“反跛鸭法案”,其核心是为了减少总统的跛鸭时段,从11月大选结束到次年3月新总统上任,需要四个月呢。4个月的过渡期可以发生很多事情,比如1860年从11月到1861年3月,南方几个州就脱离联邦了,林肯根本喝止不住,跛鸭总统布坎南劝了也没用,可以想象,假如布坎南能尽快把总统权力交给林肯,打南方诸州一个措手不及,是有一定可能压制住南方分离主义的。

    早年宪法这样规定是因为当时交通水平差,选举总统,计票,产生选举人团,选举人团选举,确认总统当选等等手续都很缓慢。所以给当时政府四个月时间准备是合理的,从11月初到三月下旬,四个半月的时间足够处理这些了。而且选举不仅仅是总统选举,每年的总统选举必然伴随着国会选举,100%的众议院议席和33%的参议院议席都要重新选举。每年国会开在3月也合理啊,1月北方大雪封山来不了DC怎么办。

    随着交通条件的改善,选举日和履职日之间时间缩短是非常合理的,很多国家的选举日和当选官员就职的间隔都很短,议会制国家选出新总理到新总理上台往往只有几天,很多国家规模不大的总统制国家也能选出总统快速就任,这减少了很多总统发动自我政变的风险,正所谓“夜长梦多”。

    1933年初通过第20修正案,这样1936年的总统选举就可以用上了。

    Section 1

    The terms of the President and the Vice President shall end at noon on the 20th day of January, and the terms of Senators and Representatives at noon on the 3d day of January, of the years in which such terms would have ended if this article had not been ratified; and the terms of their successors shall then begin.

    Section 2

    第二段其实是有点费解的。一般中国读者看到美国参众两院会想到中华人民共和国的人大常委会。大家会普遍认为美国的立法机构是常设机关,议员常年坐在国会大楼里上班。其实不是的。很多时候国会根本不开会,国会议员们也没有坐在华盛顿的办公室里办公。他们可能在选区内活动,可能在华盛顿参加其他的活动,甚至可能在其他地方参加公共事务。

    和行政,司法等机构大量日常(day to day)业务不同,自古以来,议会议会,是来讨论议事的。议员们普遍工资低下甚至不领工资,古代凡是在贵族制度下搞议会,议员多半是富裕的乡绅,他们来议事是因为吃饱了没事干妄议国家大事,对统治者构成建议,意见,抗议,支持等效果。所以议员和总统部长不同,议员很多是兼职的。当然现代政治活动强度高,国会和州议员很难有一份其他工作。当然如果你把政治尺度缩小到村,镇,小城市这个层次,你就会看到,村长镇长往往是全职的,负责村镇行政管理,但是市议会议员往往有其他工作,比如开农场,当学校教导处主任之类。

    即使议员全职,他也不会天天在国会上班,国会一年开会的次数并不多,大部分时候议员都在跑各种业务。所以国会一年召开次数并不多,而且当国会议员低于法定人数的时候,即使在一起他们也不能召开会议。

    国会这个“非常务”的属性其实是有bug可以利用的。CGP Grey就有一个视频讲这个

    总统可以利用国会休会时期(recess)任命一个临时法官或者部长,然后国会必须回来开会才能把这个临时的弄掉。那么国会下次休会呢?总统又任命一个临时的,就卡你bug怎么了?

    第三节是讲总统的继承顺序,和原版以及12修正案类似,当选总统在就职前去世,则当选副总统继任。如果选不出总统,或者当选总统不符合资格,则当选副总统代理总统。如果总统和副总统都选不出来,则国会可以选择代理总统,国会也可以立法确定在此情况下总统的继承顺序。

    这点和12修正案不同。12修正案原来的继承顺序是,如果国会选不出总统,则副总统自动成为总统。而现在改了,如果产生不了总统和副总统,国会可以订立下位法(现在用的是Presidential Succession Act of 1948)来决定总统产生顺序。

    这一条取代了不灵活的12修正案的继承顺序(总统选不出则副总统成为总统)。关于总统的继承顺序,25修正案又给出了额外补充。

    总统继承权力交给国会,算是一次立法权对行政权的胜利。

    第五节解决祖父条款,第六节是日落条款。之前讲过这两种情况,现在再补充一下。祖父条款解决的是“立法前”问题,也就是和本法抵触的既成事实(fait accompli)怎么办。答案是既成事实不去动。日落条款解决的是“立法后”怎么办,比如关于税收的法律,就很容易出现日落条款,因为收税是按照今天的情况收的,明天情况未知,所以税法条款就会出现法律本身的有效期,过期该法律失效,税的问题交给将来的国会处理。
